Outline of Australia's Visa System
A brief introduction to Australia 's visa system maybe helpful as part of any consideration to engage our services.

General Requirements : Anyone who is not an Australian citizen needs a valid visa to enter and stay in Australia .

Types of Visas: There are many types of visas, each designed to suit a specific purpose, the length of the proposed stay in Australia and the type of activities people want to do when they get here.

Visas can be divided into two broad groups - permanent (migrant) visas , which allow permanent residence in Australia ; and temporary visas , which have a time limit on the period of stay in Australia .

All temporary visas are issued with conditions. Some conditions restrict employment or relate to studies. All conditions listed on the visa must be observed or there is a real risk that the visa may be cancelled. Note - Visitors/tourists cannot do any work. (Work means any activity for which a person would normally be paid, irrespective of whether you are paid or given some other kind of reward).

Services Offered

If you are planning to come to Australia, either for temporary reasons or intend to permanently migrate to Australia, you will need to make a visa application and obtain an appropriate Australian immigration visa before you can lawfully enter Australia . 

If you have already entered Australia , and your immigration visa is about to expire, you will need to make another visa application and obtain an appropriate visa before the expired date so that you can continue to stay lawfully stay in Australia .

There are over 100 subclasses of visas that comprise the permanent and temporary visa groups. Making a successful application requires that the applicant(s) meet the various criteria that are associated with the particular visa sought.

Do I need to use a migration agent to help with my application ?

You are not required, by Australian law, to use a migration agent to help with your application.

A Migration Agent is someone who advises you on how to obtain a visa or complete your sponsorship obligations. In choosing a Migration Agent, Australia 's Department of Immigration recommends you use a registered Migration Agent. Registered Migration Agents must demonstrate that they have a thorough knowledge of Australia 's immigration laws and are of good character. If you use a registered Migration Agent, you can be sure the agent has met the entry standards for registration and the requirements for annual re-registration.

Agents are also required to abide by the Migration Agent's Code of ethics, which is contained in the Migration Agents Regulations.

Choosing whether to use a Migration Agent depends a lot on your personal situation, the complexity of your case and your ability and willingness to deal with the various aspects that will comprise your application and your ability to deal with any follow up matters arising from your application.

Note that the protection which clients have in terms of integrity, competence and accountability does not apply to non-registered agents. Such agents cannot operate in Australia but are able to operate in other countries where Australian law does not apply.

What Can We Do ?

You can expect that we will:

  • Provide a preliminary assessment on your eligibility for the Australian visa sought and advice on the applicable government charges involved. You can expect us to be frank and candid about your prospects of success;
  • Provide this assessment free of charge unless the likely complexity of your case requires detailed consideration by us. If that is the case you will be advised and a fee payment will be negotiated with you;
  • Provide you with a written proposal, before starting work on you application, of the services to be provided, the fees, other costs and payment schedule.
  • Provide timely and accurate advice in relation to all aspects of your application;
  • Ensure that your application is prepared correctly and submitted with all the required documentation;
  • Act in accordance with the law, your legitimate interests and your instructions;
  • Keep you informed about the status of your application and any relevant changes to policy or regulations that could affect the outcome;
  • Tell you in writing of the outcome of your application as soon as practicable after we are advised.
  • Charge fees that are reasonable and consistent with the work to be carried out on your behalf.
  • Ensure that your monies are deposited and held in our clients' account.
  • Continue to maintain professional indemnity insurance which covers clients against losses caused by negligent advice.
  • If confirmed by you, provide and coordinate post arrival support services to ensure that your entry and settlement in Australia proceeds smoothly.

Costs and Fees

There is no statutory scale of fees for work performed by migration agents. However, you can expect that we will charge a fee that is reasonable in the circumstances of your case.

Fees applicable will depend on the services to be performed. Clients will be given written confirmation of the terms of the service to be rendered and the costs.

Clients will be given written notice of any material change to the estimated cost of providing a service, and the total likely cost because of the change, as soon as possible after we become aware of the likelihood of the change occurring.

 Consultation Policy

We are happy to receive telephone, facsimile or email enquiries regarding the immigration solution you are seeking and discuss these briefly with you at no charge.

Where your situation is more complex and requires some involved consideration on our part then we offer two different price structures for immigration advice.

  • Office Consultation:. A fee may apply for personal consultations in our office. This will depend on the duration and nature of the consultation.
  • Written Assessment:. A consultation fee (to be agreed) applies where you require detailed written advice about your particular case. This written advice will be provided within 5 working days. The consultation can be in our office or via email if you unable to attend our office.

Consultation fees are waived if we are instructed to handle your case following the consultation.
